User Agreement & Policies
This Agreement governs your use of the Site and the Bodark Design service (the "Service"). The Service permits customers that have an appropriate relationship either with: (i) institutions of higher learning, fraternal organizations, honor societies and other collegiate groups (collectively, "Institutions"); (ii) corporations and small businesses; (iii) elementary and secondary schools; or (iv) other organizations, to design and purchase custom merchandise properly describing that relationship. You understand that by using the Site and the Service, you have agreed to the terms and conditions of this Agreement and you agree to use the Site and the Service solely as provided in this Agreement.
Statement of Principles
​Bodark Design values the role of custom apparel and accessories in bringing teams and communities together. We aim to support our customers in applying their meaningful and unifying design to the piece of apparel that suits their needs. We apply specific standards to maintain a balance between our customers' objectives and their freedom of expression, alongside the potential effects on others and the wider community.
Shipment/Delivery Times
Bodark Design's orders are generally delivered in two weeks. Customers who are concerned about meeting deadlines should contact a Sales Representative at sales@bodarkdesign.com. Rush orders on screen-printed apparel items are available for a 15% rush charge. Rush orders are generally delivered within one week. Delivery times may vary.

Currently Bodark Design does not ship outside of the United States.
Returns Policy
Bodark Design is committed to delivering orders with precision, punctuality, and unparalleled quality. In line with this commitment, Bodark Design offers refunds and accepts returns in cases where customers are dissatisfied with their purchases due to any of the following reasons: (a) the undecorated products are materially flawed; (b) the standard of the decoration work, such as printing or embroidery, falls below reasonable expectations; or (c) the design of the final product is substantially different from the customer's original design approved on the final quote.
Cancellation Policy
For Standard Delivery orders, you may change or cancel your order within twenty-four (24) hours of submitting your order. For Rush Delivery orders (any order requiring faster delivery than a Standard Delivery order), you may not change or cancel your order.
Limit of Responsibility
Bodark Design is only responsible for processing instructions that are actually received and does not take responsibility for issues in communication facilities not within its control that may impact the accuracy or timeliness of any orders sent. Bodark Design will not be held accountable for any losses or delays in the transmission of orders due to problems with Internet Access Service Providers, browser software issues, computer viruses, or other issues linked to Internet Access Services. Furthermore, Bodark Design is not liable for incorrect instructions provided by customers or if a credit card payment fails to be processed by the credit card company.
The content available on this site, including texts, graphics, links, or other materials, is offered on an "as is," "as available" basis. Bodark Design does not guarantee the accuracy, completeness, or reliability of the site’s materials and expressly denies responsibility for any inaccuracies or missing information. No warranties, whether implied, explicit, or statutory, including but not limited to warranties of non-infringement of third-party rights, title, merchantability, suitability for a specific purpose, or protection from computer viruses, are provided with the site’s content.

Under no circumstances shall Bodark Design be liable for any form of damage, be it direct, indirect, incidental, special, or consequential damages, losses, or expenses that arise from using this site, or the inability to use this site by any party; or related to any performance failure, error, omission, interruption, defect, operational or transmission delay, computer virus, or system failure, even if Bodark Design or its representatives have been informed about the possibility of such damages, losses, or expenses.
Intellectual Property Claims
Bodark Design respects the intellectual property rights of others. We have a policy of removing user submissions that violate copyright, trademark, or other intellectual property laws, suspending or blocking access to the design-saving or other features of our site to any user who uses our site in violation of any such law, and/or terminating in appropriate circumstances the account (if any) of any user who uses our site in violation of any such law. Pursuant to Title 17 of the United States Code, Section 512, we have implemented procedures for receiving written notification of claimed copyright infringement and for processing such claims in accordance with such law. If you believe your copyright, trademark, or other intellectual property right is being infringed by a user of Bodark Design, please provide written notice to the following agent for notice of claims of infringement:

To process your notice effectively, it must include: (i) your signature, either physical or electronic; (ii) a clear identification of the copyrighted work, trademark, or other intellectual property you believe has been violated; (iii) a detailed description of the material you claim is infringing, in a way that allows us to precisely locate it; (iv) sufficient contact details for you, such as your postal address, telephone number, and email address; (v) a declaration that you genuinely believe the use of the intellectual property in question is not permitted by the intellectual property owner, their agent, or the law; (vi) a statement confirming that the information in your notice is accurate; and (vii) a declaration made under the threat of perjury, stating that you are the rightful owner or are authorized to act on behalf of the owner of the intellectual property right that is allegedly infringed.
Indemnity
You agree to defend, indemnify and hold Bodark Design and its affiliates harmless from and against any and all claims, damages, costs and expenses, including reasonable attorneys' fees, arising from or relating to your use of Bodark Design's Site and the Service, your violation of this Agreement, or your violation of any rights of another.
Governing Law
This Agreement shall be governed by the laws of the State of Oklahoma and, where applicable, by federal law.
Changes to this Agreement
This Agreement was last updated as of the “Last Modified” date below. Bodark Design may modify this agreement at any time and will post any updates to our Site. We therefore encourage you to review this page frequently for any changes.
